Terms of Service

These Terms of Service govern your use of the castara.io website and any services provided by castara.io, a brand of Bessen International LLC, located at 1001 S Main Street, Ste 249, Kalispell, MT 59901, United States. By accessing our website or purchasing our services, you agree to be bound by these terms.

1. Services

castara.io provides hand-coded, performance-first websites and conversion rate optimisation (CRO) services. Websites are built to WCAG 2.2 AA accessibility standards using pure HTML/CSS/JS — no page builders, no CMS. For US local businesses, we also offer a dedicated ADA-compliant Website as a Service (WaaS) offering.

  • Hand-coded HTML/CSS/JS websites with no page builder dependencies
  • Performance-first builds targeting 100 PageSpeed scores
  • CRO audits, A/B testing, and conversion funnel analysis
  • ADA / WCAG 2.2 AA compliant builds for US local businesses
  • Hosting, deployment, and ongoing maintenance as agreed per project

2. Payment and Billing

Project fees are agreed upon in writing before work commences. A deposit is required to begin work. Remaining balances are due on delivery or as outlined in the project agreement. All fees are non-refundable unless otherwise stated in writing by castara.io. castara.io reserves the right to adjust pricing for future engagements with 30 days written notice.

3. Client Responsibilities

You are responsible for:

  • Providing accurate business information, copy, logo, and branding materials required for your website
  • Ensuring all content you provide does not infringe on third-party intellectual property rights
  • Reviewing and approving your website before launch
  • Consulting a qualified attorney for any legal compliance questions specific to your business

4. Intellectual Property

Upon full payment, you retain ownership of your business name, logo, and the content you provide. castara.io retains ownership of the underlying code architecture and development methodology. You are granted a perpetual, non-exclusive licence to use the delivered website.

5. Limitation of Liability

castara.io and Bessen International LLC shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising from your use of our services, including but not limited to loss of revenue, loss of business, or legal claims made against your business. Our total liability for any claim shall not exceed the total fees paid by you in the 3 months preceding the claim.

Important: castara.io does not guarantee that your website will be immune from ADA lawsuits or legal claims. We build to WCAG 2.2 AA standards to minimise risk, but conformance with these standards does not constitute a legal guarantee. See the full disclaimer at the bottom of this page.

6. Cancellation

Project cancellations must be submitted in writing to hq@castara.io. Deposits are non-refundable. Work completed to date will be invoiced at the agreed hourly or project rate.

7. Modifications

castara.io reserves the right to update these Terms at any time. Continued use of our services after changes are posted constitutes your acceptance of the updated Terms. Active clients will be notified of material changes by email.

8. Governing Law

These Terms are governed by the laws of the State of Montana, United States. Any disputes shall be resolved in the courts of Flathead County, Montana.

Privacy Policy

This Privacy Policy describes how castara.io, a brand of Bessen International LLC, collects, uses, and protects information when you visit castara.io or engage with our services. We are committed to handling your data with transparency and care.

1. Information We Collect

Information you provide directly: When you fill out our contact form, we collect your name, business name, email address, website URL, phone number, and any details you include in your message.

Automatically collected data: Our hosting infrastructure may collect standard server logs including IP addresses, browser type, referring URLs, and pages visited. This data is used for security and performance monitoring only.

Analytics and marketing: With your consent, we use Google Analytics 4 to understand site usage, and marketing tools such as Apollo and (where enabled) the Meta Pixel to measure and improve our outreach. These run only after you opt in via our cookie banner. You can change or withdraw consent at any time using the “Cookie Preferences” link in our footer.

2. How We Use Your Information

Information you provide is used solely to:

  • Respond to your enquiry or project request
  • Deliver and manage the services you purchase
  • Send service-related communications such as invoices and project updates
  • Improve our service offering based on aggregate feedback

We do not sell, rent, or trade your personal information to third parties for marketing purposes. California residents: you have the right to opt out of any “sale” or “sharing” of personal information; you can exercise this through the “Cookie Preferences” control in our footer or by emailing us.

3. Third-Party Services

  • Web3Forms — contact form submissions. Subject to Web3Forms' Privacy Policy.
  • Google Analytics 4 — anonymised usage analytics, loaded only with consent. Subject to Google's Privacy Policy.
  • Apollo.io — marketing analytics, loaded only with consent. Subject to Apollo's Privacy Policy.
  • Meta — campaign measurement where enabled, loaded only with consent. Subject to Meta's Privacy Policy.
  • GitHub — version control and code storage. Subject to GitHub's Privacy Statement.
  • Vercel — hosting and deployment. Subject to Vercel's Privacy Policy.

castara.io is not responsible for the privacy practices of third-party services. We recommend reviewing their policies independently.

4. Data Retention

We retain your contact information for the duration of our business relationship and for up to 2 years following the end of your engagement. You may request deletion of your data at any time by contacting us at hq@castara.io. We will process deletion requests within 30 days.

5. Data Security

We take reasonable technical and organisational measures to protect your information from unauthorised access, loss, or disclosure. Client website data is version-controlled on GitHub with access restricted to authorised castara.io team members only.

6. Your Rights

Depending on your location, you may have the right to access the personal data we hold about you, request correction of inaccurate data, request deletion, object to or restrict processing, and request data portability. To exercise any of these rights, contact us at hq@castara.io.

7. Children

Our services are not directed to individuals under the age of 18. We do not knowingly collect personal information from minors. If you believe a minor has submitted information to us, please contact us and we will delete it promptly.

8. Changes to This Policy

We may update this Privacy Policy from time to time. Changes will be posted on this page with an updated effective date. Continued use of our services after changes are posted constitutes your acceptance of the updated policy.

Accessibility Statement

castara.io, a brand of Bessen International LLC, is committed to ensuring digital accessibility for people with disabilities. We actively work to improve the user experience for everyone and apply relevant accessibility standards to all websites we build and operate.

Conformance Status

The castara.io website aims to conform to the Web Content Accessibility Guidelines (WCAG) 2.2 Level AA. WCAG 2.2 AA defines requirements to improve accessibility for people with disabilities — including those with visual, auditory, motor, cognitive, and other disabilities.

Technical Specifications

This website is built with the following accessibility features:

  • Semantic HTML5 structure with correct heading hierarchy (h1 through h3)
  • ARIA landmarks for navigation, main content, and footer regions
  • All interactive elements are keyboard accessible and focusable
  • Visible focus indicators on all interactive elements (WCAG 2.4.7)
  • Focus is never hidden behind sticky elements (WCAG 2.4.11)
  • Interactive targets meet the 24×24px minimum target size (WCAG 2.5.8)
  • Skip navigation link provided for keyboard users (WCAG 2.4.1)
  • All colour combinations meet or exceed the 4.5:1 contrast ratio for normal text (WCAG 1.4.3)
  • Large text and UI components meet the 3:1 contrast ratio (WCAG 1.4.11)
  • All decorative images use empty alt attributes; informative images include descriptive alt text
  • No content flashes more than 3 times per second (WCAG 2.3.1)
  • All form fields include associated labels, with accessible inline error messaging
  • Page language declared in the HTML lang attribute
  • No content relies solely on sensory characteristics such as colour or shape
  • Responsive design supports reflow at 400% zoom without horizontal scrolling (WCAG 1.4.10)
  • Animations respect the prefers-reduced-motion setting; decorative elements marked aria-hidden="true"

We are not aware of any current accessibility barriers on this website. If you encounter any issues, please contact us and we will address them within 5 business days.
